ELOY — Jesus Lugo, 22, was arrested Sept. 5 for kidnapping and aggravated assault in connection with the choking of a woman in Eloy on Aug. 29.

Lugo is charged with kidnapping for knowingly restraining a woman with the intent to inflict death, physical injury or a sexual offense.

It is a Class 2 felony with a presumptive sentence of seven years imprisonment with a sentencing range of 5.25 to 14 years, if the defendant has no prior convictions.

If the defendant has one felony conviction, a Class 2 can carry a 10.5-year presumptive sentence with a range of seven to 21 years. If there are two or more felony convictions, the presumptive is 15.75 years with a range of 14 to 28 years.

Lugo is also charged with two counts of aggravated assault via choking, a Class 4 felony.

He was indicted on the charges Sept. 11 by a Pinal County grand jury.

Lugo remains in the county jail pending the posting of a $50,000 secured bond and is scheduled to be officially arraigned in Pinal County Superior Court on Friday at 8:30 a.m.
